Overpayments. Contractor promptly shall refund to Purchaser the full amount of any erroneous payment or overpayment. Such refunds shall occur within thirty (30) calendar days of written notice to Contractor; Provided, however, that Purchaser shall have the right to elect to have either direct payments or written credit memos issued. If Contractor fails to make timely refunds of overpayment(s) (either directly or by credit memo), Contractor shall pay Purchaser interest at the rate of one percent (1%) per month on the amount overdue thirty (30) calendar days after notice to Contractor.
Overpayments a. In the event that an employee receives wages or benefits from the Agency to which the employee is not entitled, regardless of whether the employee knew or should have known of the overpayment, the Agency shall notify the employee in writing of the overpayment which will include information supporting that an overpayment exists and the amount of wages and/or benefits to be repaid. For purposes of recovering overpayments by payroll deduction, the following shall apply:
Overpayments. If it is determined by DSHS, or during the course of a required audit, that the Contractor has been paid unallowable costs under this or any Program Agreement, DSHS may require the Contractor to reimburse DSHS in accordance with 2 CFR Part 200.
Overpayments. 19 Any payment(s) made by COUNTY to CONTRACTOR in excess of that to which 20 CONTRACTOR is entitled under this Agreement shall be repaid to COUNTY, in accordance with 21 any applicable regulations and/or policies in effect during the term of this Agreement, or as 22 established by COUNTY procedure. Any overpayments made by COUNTY which result from a 23 payment by any other funding source shall be repaid, at the discretion of ADMINISTRATOR, to 24 COUNTY or the funding source. Unless earlier repaid, CONTRACTOR shall make repayment 25 within thirty (30) days after the date of the final audit findings report and prior to any 26 administrative appeal process. In the event an overpayment owing by CONTRACTOR is collected 27 from COUNTY by the funding source, then CONTRACTOR shall reimburse COUNTY within 28 thirty (30) days thereafter and prior to any administrative appeal process. CONTRACTOR agrees 1 to pay all costs incurred by COUNTY necessary to enforce the provisions set forth in this 2 Paragraph.
Overpayments. If the Contractor becomes aware of a duplicate contract financing or invoice payment or that the Government has otherwise overpaid on a contract financing or invoice payment, the Contractor shall—
Overpayments. 4001 The Employer may not make deductions from wages unless authorized by statute, by Court Order, by Arbitration Award, by this Agreement, by the Union or to correct an overpayment error made in good faith. Where an error has been made in good faith, the Employer shall be entitled to recover any overpayment made, for a period of time that does not extend further back than twelve (12) months from date of discovery, provided:
Overpayments. Grantee shall refund to the Department all overpayments made by the Department within 30 calendar days after discovery or receipt of written notice from the Department.
Overpayments. Where an audit under Section 11.1 reveals that the Operator has charged AHS amounts for which Service Fees were not payable at the time when the Service Fees were payable, the Operator shall, within thirty (30) days from the receipt of a written statement of overcharges from AHS, pay to AHS an amount equal to one hundred (100%) percent of the overcharged amount in addition to all reasonable costs incurred by AHS in the inspection or audit, unless otherwise expressly agreed to in writing by AHS.
Overpayments. Employees who were overpaid for any reason other than those specified in Section 19 shall receive written notice of the overpayment and the opportunity to discuss the matter with the Human Resource Services Division. The employee shall be notified in writing. The payment or recovery of payroll errors shall be limited to the sum over paid during the current fiscal year and the previous fiscal year. In addition, payroll records will be corrected for all future wage and/or salary payments.
Overpayments. 37 In the event Provider fails to comply with any of the terms and conditions of this Contract and 38 results in an overpayment, North Sound BH-ASO may recover the amount due HCA, MCO, or 39 other federal or state agency subject to dispute resolution as set forth in the contract. In the 40 case of overpayment, Provider shall cooperate in the recoupment process and return to North 41 Sound BH-ASO the amount due upon demand.
